Utah E-Filing Training Schedule for 2010

Here is a schedule of online training for efiling for the next few weeks. Click on the link next to the class you would like to register for.

These training sessions are on-line and are currently free of charge.

To attend the meeting a few minutes before the scheduled training click on the link next to the scheduled date. After you register for the meeting you will be provided with the conference call-in number and you will be connected to the online training using your browser.

Is efiling mandatory?

Currently the Utah Courts have made participation in the efiling system voluntary. As efiling use grows in the state, that may change. Efiling is encouraged as it will allow firms to reduce the amount of paper and staff time used to deliver documents to the courts. EFiling is expected to allow the courts to refocus court support staff to other activities and improve the overall efficiency of the courts.

Who can efile?

Licensed attorneys can efile if they have an account. If you are an attorney licensed by the court you can request an account as an attorney.

What are the efiling options?

The Utah Courts have created a system that encourages free market participation. Attorneys may either choose to create an individual user account and use the web based eFlex filing system by Tybera located at http://efiling.utahbar.org, or, they may build a solution that connects their firm or organization directly to the court’s system. The best path will depend on the size of the firm, the number of filings completed in an average month, and the technical expertise of the organization. Other vendors may also undergo certification and come into the market in 2010. As new vendors arrive they will be announced by the Courts and the state Bar.

Can I share an account?

While a firm may set up a few filer accounts and funnel all the firm filings through them, there may be some administrative challenges in managing the communications on all the cases. The filing account manager will become a switching station for all the communication for all cases filed by that person. The account manager will be responsible for all information filed through that account.

How do I create an efiling system for a firm?

Large volume filers or large firms may find themselves incentivized to create their own direct connection to the court’s filing system. This will require either building their own private web-based portal similar to the Tybera eFlex system in use at http://efiling.utahbar.org, or integrating their existing case management system directly to the court’s efiling system.

Integration is a process of connecting the firm's case management system to the Court's programming interface for efiling and then going through the one-time process of certification that confirms that the integration meets the requirements of the Courts. (Tybera has an eFlex module that can greatly reduce the amount of time required to complete this type of integration.)
Firms are encouraged to explore this option with their case management vendor and determine if it will be a cost effective solution for the long term.

Does it cost to efile?

There are several registration options displayed below.

Once you have registered there is no additional efiling fee, however the standard court fees are still applicable. Please refer to the Court's web page to review the filing fees charged by the court.

How do I get an account?

Go to the efiling website located at http://efiling.utahbar.org and look for the Request Account button to register for an efiling account. This will take you through a series of screens that will ask you questions. The first screen will ask you to review the Terms of Usage agreement established by the court. To continue you must select the radio button that you 'Agree' to the terms of use.

After you have agreed to the terms of usage, you will be asked to identify what company or firm you are associated with. Each user is associated with an organization. For example, if you are an attorney and you belong to a law firm you would select the name of that law firm if it already exists in the pull-down list. The pull-down option contains the organizations currently registered in eFlex. If your organization is not listed, click the second radio button and type in your law firm's name and then click Submit.

The next screen has several questions to fill out. An asterisk (*) next to a field indicates that the information is required. Select your own username and password. Your username must be unique. If the username you enter is not unique you will be prompted to select a different username. Once all the information is completed a request to approve your account will be given to the Administrator. As soon as the Administrator approves your account you will receive an email message at the email address you entered with your registration information that your account is approved. You may then begin efiling.

How do I get training?

The Utah State Bar has held several training sessions and will continue to do so throughout 2010. The Bar’s programs are accredited for 1 hour CLE and can be found at http://www.utahbar.org/cle A video presentation of this program can be found online after December 1st, 2009 and is accredited for 1 hour of self study CLE credit. Tybera may also elect to host webinar training events. Those events will be announced on the efiling information site as they become available. Documentation of the system is also available online at www.utcourts.gov/efiling. Many paralegals and attorneys may find that this system is not unlike other systems and that reading the online documentation is sufficient to operate the system.

What can I eFile?

You can initiate several types of general civil cases through the efiling system and efile follow-up filings on those case types as well. General domestic filings and criminal filings are expected to be available later in 2010 and will be announced once they are released.

You can file on cases in which you are a named party. When you are not sure if you can efile on a particular case, when you select 'File to an Existing Case' you can type the case number and a participant's last name and press Submit. The efiling system will query the Court's case management system to see if you can file on this case. If you cannot, it will return an error, otherwise it will allow you to continue efiling on that case.

Do I need to install any software?

The efiling system is browser-based. You do not need to install any special efiling software. You do need a computer that is connected to the Internet and has a web browser installed. You may use Firefox from Mozilla, Internet Explorer from Microsoft, or any other HTML 4.0 standards compliant browser.

How do I create my documents?

All submitted documents must be in text-based PDF format. It is anticipated that your computer will have a word processor such as Microsoft Word or Corel WordPerfect to generate the initial documents and that you will have access to an application capable of converting those documents to the required text-based PDF. If you do not have a conversion application there are may free ones that may be found online. An example of a free PDF Conversion application that is in broad use is the CutePDF writer located at http://www.cutepdf.com/.

How many documents can I include in my submission?
Is there a size limit per document or submission?

There is no limit to the number of documents as long as each document does not exceed an individual size of 4 MB, or, exceed an overall submission size limit of 20 MB. The 'Add a Document' page in the efiling system will count how much disk space each document takes up and will display that information as you add documents.

How do I include images or paper exhibits (scanning)?

Many times you will need to include paper documents such as a copy of a contract, a copy of a bounced check, or some other item in your submission. You must scan these types of paper exhibits into electronic PDF format in order to efile them to the Court’s system. Determining the type of scanner and developing a process for scanning is outside the current scope of this document.

Scanned documents should meet the following criteria for submission:

1. Documents should be no more than 4 megabytes per file. The number of pages that will fit inside of the 4 MB limit will depend on the amount of information on each page. Images, graphs, or other media renderings will increase the size of the file. If you have created a document that is over 200 pages and is larger than 4 MB in size you need to split the document up into volumes, sections, or chapters.

The efiling system has the ability to load attachments or continuations of documents and identify that they are associated with a previously included document. Make sure you always include the main document first when you split a document into smaller sections.

2. Scan the documents in black and white. (Create color scans only if the loss of color will jeopardize the integrity of the information being scanned.)

3. Submissions should be in PDF format. Check the operation of your scanner to see if it supports output to PDF. If it does not, you will want to open up the scanned image file and then convert it to PDF using an application such as CutePDF.

What is the proper way to enter the Party Name information when adding a party to a case?

Entering Party Information (such as Plaintiff or Defendant)

  Adding Alias : Alias information is assiciated with the party being added to the case, not the attorney.

When adding a document what should I put in Additional Text field?

Documents
Additional Title Text : Document type is already included in the title so just add the additional text. 

For example:
'A' (type of document) + 'B' (additional text)  = Document title in the CORIS Database.  

Do not enter the type of document in the Additional Text field.  If the document type is included in the Additional Text field, CORIS will record in the case history 'Motion Motion to ...'.

In the Add a Document page, when should I use the Other document type?

Document Description : Please look through the Document Type dropdown list when selecting the type of document and choose a description that meets your needs.  For example, instead of choosing 'Other' and adding the additional text 'Motion to Reduce Time', select 'Motion', and in the Additional Text field enter 'To Reduce Time'.

Only use the ‘Other’ document type when there is nothing else close to what you are filing.

When a filer's subscription expires can they still access their notifications?

Filers can access their notifications but they cannot download the files or efile.

What information does eFlex store about the attorney's association with the Utah Bar?

eFlex stores the attorney's Utah Bar number and organization they are associated with as well as email and physical addresses in their Profile. Tybera does not resell this information. The status of the attorney with their relationship with the Bar is not information that exists in eFlex.  The Utah Bar updates the Utah AOC on a regular basis regarding the status of an attorney.  Depending on that status, the efiling system will either accept or reject their submissions.

Can an attorney register with multiple addresses?

eFlex stores one address for the attorney and one address for their organization.  The attorney may choose to use the same address as the organization.  Most courts do not use the address stored in eFlex.  Instead they use the official registration process to identify the attorney’s contact information.  In Utah this information is based on the Utah Bar registration process.

What happens when an attorney works for two different law firms?  Prosecuting Attorney, Public Defender, Judge, Arbitrator?

eFlex is designed to understand roles.  An attorney acting in private practice and also as judge or arbitrator on certain cases should have two different login accounts. The login account used as a judge or arbitrator will not use the attorney bar number.  Instead they will use an ID issued by the Utah AOC for the judge or arbitrator accounts.  An attorney acting as both a private attorney and a public defender or prosecuting attorney will use the same account with their Utah Bar number.

What is the Utah API for?

The Tybera eFlex efiling system is designed to allow multiple disparate systems to interact with the Utah efiling system.
 
The system has two logical parts, the Filer Interface where the filer prepares their submissions and receives notifications, and the Clerk Interface where the court clerk reviews the submissions and records them or returns them due to some error.

Many attorneys are using the Utah Bar Filer Interface by subscribing to that system.  Other vendors can develop a Filer Interface to create a competitive environment for the efiling process and not limit the filer’s options to just one system. 

Some high volume filers find it worth the expense to integrate their case management system to the court system directly and bypass any filer interface.  This results in a highly automated process between the attorney’s CMS and the Court's efiling system.  For more information about the API option contact Tybera at (801) 226-2746 x113.

Can an attorney from another state register directly with the court?

Attorneys licensed in another state that wish to participate on a case in Utah at Pro Hac Vice, must first contact the Utah Bar to register for each case they wish to participate on. Once this process is properly completed the attorney may register in the eFlex system.  It is the responsibility of the clerks to insure that the proper registration of a Pro Hac Vice is completed on each case and they will manually determine whether to accept  a submission from a Pro Hac Vice.
